In consideration of being permitted to participate in any program or activity offered by Queen City Sports Academy (“QCSA”), the Participant and, when applicable, the Participant’s Parent/Guardian acknowledge and agree to the following:
Participation in volleyball, athletic training and related activities involves inherent and other risks, including but not limited to falls; collisions with participants, coaches, equipment or facility structures; contact with volleyballs or other objects; sprains; strains; fractures; concussions; head, neck, back or spinal injuries; illness; permanent disability; death; and property damage.
These injuries and damages may result from the Participant’s actions or inactions, the actions or inactions of others, the rules of play, the condition of the premises or equipment, or risks that are presently unknown or not reasonably foreseeable.
The Participant and Parent/Guardian voluntarily accept and assume all risks associated with participation in QCSA programs and activities, whether known or unknown, foreseeable or unforeseeable.
The Participant and Parent/Guardian represent that the Participant is physically capable of participating. Before participating, the Participant should inspect the facilities and equipment to the extent reasonably possible. Any unsafe condition, injury or other concern must be immediately reported to a QCSA coach or Queen City Sportsplex staff member. The Participant must stop participating until the condition has been addressed or the Participant has been cleared to continue.
To the fullest extent permitted by Ohio law, the Participant and Parent/Guardian, on behalf of themselves and their respective heirs, representatives, executors, administrators and assigns, release, waive and discharge:
- Queen City Sports Academy;
- Queen City Sportsplex, LLC;
- Their respective owners, members, officers, directors and administrators;
- Coaches, trainers, employees, independent contractors, agents and volunteers;
- Sponsors, advertisers and representatives;
- Owners, landlords, tenants and operators of premises used for QCSA activities; and
- Other program participants, where legally applicable.
Collectively, these individuals and organizations are referred to as the “Released Parties.”
The Participant and Parent/Guardian agree not to bring a claim or lawsuit against the Released Parties for any injury, illness, disability, death, property loss or other damages arising from or related to participation in a QCSA program or activity, including claims allegedly resulting from the ordinary negligence of a Released Party, to the fullest extent permitted by Ohio law.
The Participant and Parent/Guardian accept personal and financial responsibility for any injury, illness, disability, death, property damage or other loss resulting from participation.
This waiver and release does not apply to conduct that cannot legally be released or waived under Ohio law.
